Min Hee-jin Partially Wins Damages Lawsuit Against Malicious Commenters... Four Out of Eleven Found Liable
Court: "Insulting Language Is Unlawful"
Four Defendants Ordered to Pay 300,000 Won Each
Min Hee-jin, former CEO of ADOR and current CEO of OK Records, has partially won a damages lawsuit against individuals who posted malicious comments online. The court found four out of the eleven defendants liable for compensation.
According to the legal community on April 20, the Seoul Western District Court ruled in favor of Min in part in two damages lawsuits she filed in February.
Judge Ha Jinwoo of the 5th Civil Division acknowledged the responsibility of three out of four defendants in one case. In another case, Chief Judge Lee Gwanhyeong of the 12th Civil Division found one out of seven defendants liable for compensation, while dismissing claims against the others.
The four individuals found liable must each pay 300,000 won to Min. Investigations revealed that these individuals had used vulgar and insulting language in comments on related news articles.
The court stated, "While the expression of critical opinions is generally permitted, insults and defamatory language that damage an individual's character cannot be justified," adding, "Since the plaintiff's social reputation was harmed as a result, the defendants are liable for compensating mental damages."
