KCC Publishes Commentary Reflecting Amendments to the Location Information Act
Including Specific Interpretation Guidelines Such as Location Information Range
[Asia Economy Reporter Minyoung Cha] The Korea Communications Commission and the Korea Internet & Security Agency (KISA) announced on the 16th that they have revised and published the commentary on the "Act on the Protection and Use of Location Information," which has been in effect since April 20.
This commentary comprehensively covers the amendments related to the Location Information Act since the publication of the "Commentary on the Act on the Protection and Use of Location Information" (2010) and the "Commentary on Administrative and Technical Protection Measures for Location Information" (2015). It explains the purpose and key contents of individual provisions with examples. It also includes interpretation guidelines covering frequently asked questions and contentious issues from users and businesses.

For example, ▲ regarding the "scope of location information," one of the core concepts under the Location Information Act frequently inquired about by businesses, it clarified that information incidentally identified from services without the purpose of collecting location information is excluded from location information. ▲ With the easing of entry regulations for personal location information businesses, matters related to the registration system were also included. To assist businesses' understanding, the revised registration forms were excerpted from the Korea Communications Commission regulations under the Location Information Act, titled "Regulations on the Protection and Use of Location Information." ▲ Additionally, with the establishment of the "Standards for Administrative and Technical Protection Measures for Location Information," methods for implementing each protection measure were introduced. ▲ The disclosure items of personal location information processing policies were compared with the statutory disclosure items in terms of terms of use, ▲ and draft terms of use for location information businesses and location-based service businesses were also prepared.
The Korea Communications Commission plans to post the revised commentary on the websites of the Commission and the Location Information Support Center to encourage voluntary compliance by users and businesses subject to the Location Information Act.
Meanwhile, the Commission will operate a six-month grace period until October 20 this year to allow businesses to prepare and ensure the stable establishment of the amended Location Information Act system.
