'Strengthening Rights Protection' Expansion of Patent Trial Public Defender Application Period and Support Targets
[Asia Economy (Daejeon) Reporter Jeong Il-woong] The protection of the rights and interests of socially and economically disadvantaged groups involved in patent trials will be strengthened.
The Korean Intellectual Property Office (KIPO) announced on the 10th that it will revise and implement the "Regulations on the Appointment and Operation of Court-Appointed Patent Trial Representatives."
The amendment, which focuses on extending the application period for court-appointed representatives and expanding the scope of eligible applicants, will take effect from the 11th.
The court-appointed patent trial representative system supports socially and economically disadvantaged parties without legal representation by appointing representatives for them.
KIPO revised the system so that both the petitioner and the respondent can apply for a court-appointed representative until the conclusion of the trial, whereas previously, petitioners could apply within one month from the date of trial request, and respondents only until the deadline for submitting their response.
Additionally, the scope of eligible applicants has been expanded from only medical benefit recipients under the National Basic Livelihood Security Act to all benefit recipients under the same Act. This aims to guarantee opportunities for socially and economically disadvantaged groups who need court-appointed representatives, thereby enhancing their rights and interests.
Furthermore, KIPO will simplify the application process for appointing court-appointed representatives during patent trials by allowing applicants to omit submission of documents that can be verified through administrative information sharing.
The documents that can be omitted include the Certificate of National Basic Livelihood Security Recipient, Disability Certificate, Certificate of National Merit (or bereaved family), Certificate of 5.18 Democratic Merit (or bereaved family), Business Registration Certificate, and Small and Medium Enterprise Confirmation, among others.

Lee Jae-woo, President of the Patent Trial and Appeal Board, stated, "The revision of the regulations related to the court-appointed representative system focuses on preventing situations where parties in trial cases cannot appoint representatives due to financial difficulties," and added, "The Patent Trial and Appeal Board will continue to do its best to expand support for the protection of intellectual property rights for socially and economically disadvantaged groups."
