Drunk Defendant Accused of Sexual Assault on Woman in Her 70s Even Swore and Misbehaved in Court
The Court, "Difficult to See Signs of Remorse, and No Settlement with Victims," Rejects Appeal
[Asia Economy Reporter Ra Young-cheol] A defendant accused of assaulting and sexually assaulting a woman in her 70s while intoxicated caused a disturbance in court by insulting the judge, prosecutor, and the victim's family, claiming the sentence was unfair. The court dismissed the defendant's appeal.
On the 25th, the Criminal Division 1 of the Chuncheon Branch of the Seoul High Court (Chief Judge Park Jae-woo) announced, "Defendant A (32), who was charged with rape and injury under the Special Act on the Punishment of Sexual Crimes, was sentenced to 12 years in prison as in the original trial, ordered to complete 120 hours of sexual violence treatment programs, and to have his personal information disclosed for 10 years."
The appellate court stated in its ruling, "Although it is acknowledged that the defendant was intoxicated at the time, considering that he relatively well remembers the circumstances of the crime and reported it immediately, it is difficult to view him as being in a state where his ability to discern or make decisions was impaired."
The court pointed out, "The defendant broke into the bedroom of a vulnerable elderly victim, committed a sexual crime while mercilessly using violence, causing significant injuries. The crime scene was extremely horrific, and the victim suffered severe mental and physical pain."
Furthermore, the court rejected defendant A's claims, stating, "Despite this, it is difficult to see any remorse from the defendant, and no settlement was reached with the victims," and dismissed the appeal.
A was charged last October with repeatedly punching the face of the woman in her 70s, the owner of the inn where he was staying, while she was naked, and sexually assaulting her.
A's lawyer requested leniency, saying, "On the day of the crime, he drank eight bottles of soju and then two more bottles at the crime scene, so he has no memory of the crime and committed it impulsively while intoxicated. Please consider his voluntary surrender," but the court did not accept this.
Previously, when the prosecution demanded a 12-year prison sentence in the first trial, A hurled insults. He also had an argument with the victim's family present in the courtroom.
