Samsung on High Alert After Lee Jae-yong Sentenced to 9 Years... Judicial Risks Persist
[Asia Economy Reporter Changhwan Lee] Samsung Electronics Vice Chairman Lee Jae-yong was sentenced to 9 years in prison on the 30th in the retrial of the 'National Pension Scandal' case, raising the likelihood that Samsung's judicial risks will continue into next year. The business community remains concerned about the prolonged judicial risks for Samsung, which is highly important to the Korean economy, amid worsening domestic and international management environments.
On the day, the special prosecution team led by Park Young-soo requested the court to sentence defendant Vice Chairman Lee to 9 years in prison during the sentencing hearing held by the Criminal Division 1 of the Seoul High Court. Considering that some charges were acquitted by the Supreme Court, the prosecution lowered the requested sentence from the 12 years requested in both the first and second trials.
Samsung viewed this as an expected outcome but hopes that in the final verdict, which could come as early as January next year, Vice Chairman Lee will receive a suspended sentence, bringing an end to the judicial risks related to the National Pension Scandal that have continued for several years.
Since the special prosecution investigation into the National Pension Scandal began in 2016, Vice Chairman Lee has undergone about four years of detention, release, and retrial. Concerns about management disruptions, such as postponing large-scale mergers and acquisitions (M&A) or investments, have been consistently raised during the absence of the group’s head.
With the possibility that Vice Chairman Lee may be sentenced to actual imprisonment and re-incarcerated this time, Samsung remains in a state of high tension. The business community believes that if the absence of the group’s head occurs again, especially after Chairman Lee Kun-hee’s passing and the increased importance of Vice Chairman Lee’s role, it would pose a significant threat to Samsung’s management.
