Ministry of Justice: "Request for Disciplinary Committee Member List Hinders Democratic Process"
[Asia Economy Reporter Baek Kyunghwan] The Ministry of Justice rebutted the side of Prosecutor General Yoon Seok-yeol, who requested the list of members of the prosecutor disciplinary committee, saying it "seriously hinders the democratic and fair progress of the disciplinary committee."

The Ministry stated, "According to the Prosecutor Disciplinary Act, the National Public Officials Act, and the Public Officials Disciplinary Regulations, the list of disciplinary committee members is not to be disclosed to ensure the fairness of the committee's deliberations and resolutions, and there is also an obligation to prohibit leakage of confidential information."
It added, "Despite the fact that the disciplinary committee member list has never been disclosed even once, requesting the prior disclosure of the list and claiming that the committee would be invalid if this is not accepted seriously hinders the democratic and fair progress of the disciplinary committee."
Regarding the disciplinary committee scheduled for tomorrow, the Ministry also mentioned the guarantee of the defense rights of Prosecutor General Yoon's side. It said that the right to request disqualification of the accused in accordance with the procedures prescribed by law will be guaranteed. The Ministry explained, "Procedural rights and defense rights, which no one has enjoyed in previous disciplinary procedures, such as allowing access to disciplinary records, will be guaranteed to the fullest extent."

The Ministry also rebutted the claim that since Minister of Justice Choo Mi-ae is the disciplinary requester, she should not convene the disciplinary committee or notify the hearing date. The Ministry stated, "According to the regulation that the person who requested the disciplinary action cannot participate in the case deliberation, the minister cannot be involved in the deliberation, but it is natural to proceed with procedures such as convening the meeting until a deputy is appointed."
