Review of the Appropriateness of Military Noise Damage Compensation Every 5 Years

On the 27th, the Ministry of National Defense announced, "From today until September 7, we will publicly notify the draft enforcement decree and enforcement rules for the 'Act on Prevention of Noise from Military Airfields and Shooting Ranges and Compensation for Damage' (hereinafter referred to as the Military Noise Compensation Act)."
As a follow-up measure to specify detailed standards such as compensation payment criteria and periods ahead of the full enforcement of the Military Noise Compensation Act, which was passed last year and is set to take effect on November 27, the detailed standards have been prepared to provide compensation to residents affected by noise around military airfields or shooting ranges starting this November.
According to the enforcement decree and enforcement rules, the basis has been established to allow noise impact surveys conducted for compensation payments to be prioritized and implemented starting with the most urgent cases. Additionally, the review cycle for the validity of designated compensation areas has been shortened from the existing 7 years to 5 years. The Ministry of National Defense explained that this is the result of gathering opinions from local governments and related ministries.
Along with this, in order to guarantee the property rights of residents living near military airfields or shooting ranges, existing restrictions such as prohibiting the construction of residences or public facilities have been eased.
The Ministry of National Defense plans to finalize the enforcement decree and enforcement rules by early November after legislative review by the Ministry of Government Legislation and approval by the State Council following this public notification.

Meanwhile, the Military Noise Compensation Act passed by the National Assembly last year aims to allow residents to receive compensation regularly without having to file lawsuits. It will be enforced from November 27 this year. However, since noise impact surveys must be conducted for each affected area before compensation payments, full-scale compensation is expected to begin in 2022. The Ministry of National Defense explained that for compensation occurring before the full payment starts on November 27 this year and before 2022, statutory interest will be added and paid later.
