30-Year-Old Man Sentenced to 10 Years for Sexually Assaulting 14-Year-Old Niece
[Asia Economy Intern Reporter Min Jun-young] A man in his 30s who sexually assaulted his teenage nephew at his sister's house was sentenced to prison.
The Jeju District Court's 2nd Criminal Division (Chief Judge Jang Chan-soo) announced on the 2nd that A (38), who was tried on charges of violating the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (rape within family relations), was sentenced to 10 years in prison.
The court also ordered A to wear an electronic monitoring anklet for 10 years after release and imposed a 10-year employment ban in child welfare-related facilities.
A's side admitted to the crime but claimed diminished responsibility, asking for consideration of his intellectual disability level 2 with an IQ of only 56.
However, the court decided on a harsher sentence than the prosecution's demand based on the fact that A had committed two previous sexual offenses.
The court explained the sentencing reason, saying, "Although the defendant suffers from an intellectual disability, the nature of the crime, including sexually assaulting his nephew, is very serious. Considering various circumstances, including that he has not been forgiven by the victim, the sentence was determined."
A was previously indicted on January 18 for sexually assaulting his niece B (14) at a relative's house in Jeju City on December 25 of last year.
