Middle School Girl Sentenced to 3 Years Imprisonment in First Trial for Peer Threats and Production/Distribution of Sexual Exploitation Material
[Asia Economy Reporter Song Seung-yoon] A female middle school student who was prosecuted for threatening a peer female student to produce sexual exploitation materials and distributing them was sentenced to prison in the first trial.
The Criminal Division 13 of the Seoul Northern District Court (Presiding Judge Heo Kyung-ho) on the 19th sentenced A (16) to 3 years and 1 year and 3 months in prison for violating the Act on the Protection of Children and Juveniles from Sexual Abuse (production and distribution of obscene materials, etc.) and other charges.
The court stated, "The victim has suffered or is still suffering great mental distress due to the crime, and since the victim's video has been distributed, there is a risk that it will continue to be spread or reproduced to an unspecified number of people, raising concerns about ongoing harm."
It added, "Although the defendant admitted the crime and showed remorse, reached a settlement with the victim, and considering that the defendant is not yet fully mature in personality, it is difficult to see that the victim's damage has been completely restored."
A was prosecuted for forcing the victim, whom she met through a mobile game, to film sexual exploitation materials from March to April this year, receiving dozens of videos and photo files, and distributing them via social networking services (SNS) and acquaintances.
At the sentencing hearing on the 5th, the prosecution requested a sentence of 9 years and 5 years in prison for A, stating, "She destroyed the victim's personality and caused irreparable damage." They also requested the court to order 200 hours of sexual violence treatment program.
