Ha Chun-hwa Wins Second Trial in Deposit Lawsuit Against 'Bbaengpa' Producer... "Compensation Amount 100 Million Won"
[Asia Economy Intern Reporter Park Hee-eun] Singer Ha Chun-hwa won a lawsuit against the production company of the Madangnori play 'Ppaengpa' after her appearance was not confirmed. The court ruled that the production company must pay 100 million won in damages.
According to reports from the legal community and Yonhap News on the 9th, the Seoul High Court Civil Division 34 (Presiding Judges Jang Seok-jo, Park Sung-jun, Han Ki-su) announced that it ruled MS Contents Group must pay Ha 100 million won in a damages claim lawsuit filed by Ha against the production company.
Previously, Ha had signed a contract with MS Contents Group to appear as the character Ppaengdeok Eomeom in the Madangnori play 'Ppaengpa,' which was held from September to October 2018.
According to the contract, the total number of performances was 14, and the contract amount was 112 million won. It also specified that if the payment of the contract amount or the balance was delayed even by one day, it would be considered a contract forfeiture. Additionally, if the performance was canceled, the party at fault was to compensate three times the contract amount.
However, MS Contents Group did not pay Ha the contract amount. Someone else appeared in the performance instead of Ha.
Ha claimed that the reason the contract was not fulfilled was due to the unilateral fault of MS Contents Group and demanded compensation of three times the contract amount.
Previously, the court ruled in the first trial that the full amount of 336 million won claimed by Ha must be compensated.

However, in the second trial, the court reduced the compensation amount to 100 million won, stating, "Considering the circumstances under which the contract was not concluded, the contract amount, the amount of damages, and the extent of Ha's efforts to fulfill the contract, three times the amount is excessive."
