Increase in US Intellectual Property Application and Registration Fees... Up to 87% Rise in Design Sector
Fees for filing and registering intellectual property rights in the United States will increase. This could add to the burden for domestic companies seeking to file and register intellectual property rights locally. The highest increase rate in the design sector reaches 87%.
According to the Korea Intellectual Property Research Institute on the 22nd, the United States Patent and Trademark Office (USPTO) recently announced a patent fee increase proposal in the Federal Register and has completed the recent public comment process.

View original imageThe announced fee increase proposal includes raising patent filing and registration fees by 5-10%, and design filing and registration fees by 10-87%, respectively.
Additionally, the Request for Continued Examination (RCE) fees will increase by 10-25% per filing. When a third or subsequent RCE is filed, a fee of $3,600, which is 80% higher than before, will be charged.
The fee for applying for Patent Term Extension (PTE), based on procedures such as drug approval by the U.S. Food and Drug Administration (FDA), will also increase by 468%.
The USPTO plans to post the finalized patent fee increase proposal in the Federal Register after the public comment process and apply it starting January next year.
Typically, the USPTO reviews fee increases every two years to cover operational costs and secure medium-term funding. In 2020, patent registration fees and others were increased by 4-25%.

Kim Hyuk-jun, a research fellow at the Korea Intellectual Property Research Institute, said, “The USPTO has continuously raised patent fees considering the workload and costs of examination. In this recent fee increase proposal, the increase rate in the design sector is relatively very high, and it is expected that the patent cost burden for Korean companies entering the U.S. market will also increase.”
