Trump's Fate Again in the Hands of the Federal Supreme Court
Former U.S. President Donald Trump has requested the U.S. Supreme Court to temporarily suspend the enforcement of the federal circuit court's ruling that denied him immunity in the 'overturning election results' case. With the November presidential election approaching, Trump's fate once again hinges on the Supreme Court's decision.
On the 12th (local time), local media including The New York Times (NYT) and Bloomberg reported that Trump requested the Supreme Court to suspend the enforcement of the ruling by the Washington D.C. Federal Circuit Court of Appeals issued on the 6th.
Trump argued, "If the president is not immune from criminal prosecution, the presidency as we know it will not exist."
Earlier, on the 6th, the Washington D.C. Federal Circuit Court of Appeals unanimously ruled that Trump does not have immunity from prosecution for crimes committed during his presidency aimed at overturning the 2020 election results. Trump, who was indicted by Special Counsel Jack Smith of the U.S. Department of Justice for inciting the January 6, 2021, Capitol riot by his supporters, had claimed immunity, but both the trial and appellate courts rejected his claim. Accordingly, he requested the Supreme Court to suspend the enforcement of the lower court's ruling. Additionally, instead of immediately appealing to the Supreme Court, he asked for the expansion of the Washington D.C. Federal Circuit Court panel to rehear the case.
Separately, the Supreme Court is also reviewing whether Trump is eligible to run for president. This follows the Colorado Supreme Court's application of Section 3 of the 14th Amendment, which disqualifies individuals who participated in insurrection from holding public office, ruling that Trump is ineligible to run in the presidential primary due to his involvement in the January 6 Capitol riot. Trump has appealed this decision to the Supreme Court.
Currently, Trump leads President Joe Biden in the polls but is hindered by 'judicial risks.' During his presidency, he repeatedly asserted presidential immunity and insisted that related trials should be halted until the November election. If Trump wins the election, he could instruct the Department of Justice to stop prosecuting him, effectively granting himself immunity.
