Court Denies Suspension of Execution for Removal of Former Marine Corps Investigation Unit Chief
Director Park Jeonghun's Side Plans to Prepare for Litigation
The former Marine Corps Investigation Unit Commander Park Jeong-hoon, who was dismissed from his post for insubordination while investigating the death in the line of duty of Corporal Chae, had his 'request for suspension of execution of dismissal from post' rejected by the court.
According to the legal community on the 25th, the Administrative Division 3 of Suwon District Court (Chief Judge Eom Sang-moon) made a decision to dismiss the plaintiff's application on the same day.
At the first hearing held on the 4th of this month, the plaintiff's side was represented by former Commander Park and his legal representative, lawyer Kim Jeong-min, while the defendant's side included lawyers representing the Marine Corps Command.
Earlier, on the 21st of last month, former Commander Park filed a lawsuit at Suwon District Court against Marine Corps Commander Kim Gye-hwan, seeking confirmation of the invalidity of his dismissal from post along with a request for suspension of the execution of the dismissal.
Park's side stated in the complaint, "The defendant never explicitly instructed the plaintiff to delay the transfer timing, and even if such an instruction was given, it is clearly an illegal order," adding, "This dismissal from post is based on a clear misinterpretation of facts and legal principles, making the defect serious and obvious."
