The at-fault vehicle's insurance company claims a 60:40 fault ratio
Attorney Han Moon-cheol says, "You should get out of the car and move to the shoulder"

Mr. A, the husband, explained, "Due to a sudden vehicle malfunction, I made an emergency stop in the second lane of the highway. To warn vehicles traveling in the same direction, I got out of the car and was signaling when my 69-year-old wife, who was still inside the vehicle, was involved in the accident."
Mr. A stated, "My wife found it difficult to get out between the first and third lanes because of the traffic. Due to the driver's urgent emergency response, she moved to the rear of the broken-down vehicle to take action. While signaling, other cars moved aside following the signals, but the driver of the offending vehicle, due to inattentiveness to the front, collided with the rear of the broken-down vehicle."
He added, "Despite unavoidable circumstances that meant the broken-down vehicle's driver could only signal for follow-up measures, the insurance company of the offending vehicle claims a fault ratio of 6:4. From the perspective of the bereaved family who suddenly lost a loved one, this is extremely unfair," he appealed.
In response, lawyer Han Moon-cheol said, "When such an accident occurs, you must first get out of the car and move to a safe shoulder to signal the cars behind. Accidents that happen during the day are usually judged as 60:40 fault ratio, but on straight roads, it can be 70:30. However, since this was on a curved road, 60:40 is possible."
