Friend's Wife Wearing Mourning Clothes at Funeral Hall Commits Quasi-Rape... Court Sentences 2 Years Imprisonment
[Asia Economy Yeongnam Reporting Headquarters Reporter Hwang Du-yeol] A man who sexually assaulted the wife of a high school classmate, the chief mourner, at a funeral received a prison sentence and was taken into custody in court.
On the 13th, according to the Busan District Court, the Eastern Branch Criminal Division 1 (Chief Judge Choi Ji-kyung) sentenced Mr. A, who was on trial for quasi-rape, to two years in prison.
Mr. A was also ordered to complete a 40-hour sexual violence treatment program and was banned from employment at child and youth-related institutions for three years.
At around 3:40 a.m. on January 27, Mr. A is accused of finding Mrs. B, the wife of his friend, sleeping in mourning clothes at the funeral hall and touching her body, committing quasi-rape.
Mr. A claimed that he committed the crime in a state of diminished mental capacity.
The court judged that he was not in a state of diminished mental capacity based on the fact that he drank alcohol, left the funeral hall, then re-entered, deliberately lay next to the victim, and statements he made to the police officers who arrived at the scene.

The court stated the sentencing reasons, saying, "The crime was committed by taking advantage of the victim, the wife of the chief mourner, who was asleep at the funeral hall, making the nature of the crime serious, and the victim is pleading for severe punishment. However, consideration was given to the defendant voluntarily receiving sexual violence prevention education and counseling related to alcohol consumption."
