Afternoon Prosecutors' Meeting Expected to Be a Turning Point

On the 11th, Oh Dong-seok, a professor at Ajou University School of Law, stated at a roundtable hosted by the People’s Solidarity for Participatory Democracy titled ‘Issues and Solutions on Telecommunication Data Collection Seen Through the Gong-su-cheo Surveillance Controversy’ that "The telecommunication technology underlying the collection of communication records is advancing, and state power is correspondingly expanding, but the legal mechanisms enabling individuals to resist this remain inadequate." He added, "It is difficult to find solutions to this issue even in overseas precedents. In South Korea, known as an internet-advanced country, accurate diagnosis and response are necessary, but it seems our legislative and judicial branches have already lost their functions."
Professor Oh also said, "The current issues with Gong-su-cheo are no different when it comes to corporations. The Constitutional Court made a decision that did not regard this issue as serious, and these things may have endangered our fundamental rights." He emphasized, "Now, a paradigm shift in awareness is needed on how to protect personal privacy rather than state secrets."
Jang Yeo-gyeong, Executive Director of the Information Rights Research Institute, said, "I believe it is time to improve the telecommunication record provision system." She explained, "Article 84 of the Telecommunications Business Act, which serves as the basis for provision, has several problems, and telecommunication records can be accessed simply by sending an official document. Although there is a department within telecommunication companies responsible for media relations, it is not controlled at all."
The controversy is expected to reach a turning point with the announcement of the results of the Gong-su-cheo prosecutors’ meeting scheduled for the afternoon. Starting at 2 p.m., Gong-su-cheo will hold a prosecutors’ meeting attended by Director Kim Jin-wook, Deputy Director Yeo Woon-guk, and all prosecutors to discuss major current issues. Although the agenda is not disclosed, it is expected that the leadership will gather prosecutors’ opinions on how to respond to the recent controversy over ‘telecommunication inquiries’ and the ‘illegal search and seizure’ issue raised by the Suwon District Prosecutors’ Office investigation team through an immediate appeal.

During the prosecutors’ meeting, discussions will be held on whether Gong-su-cheo will provide additional explanations or statements regarding these cases, maintain the existing stance that ‘there is no illegality,’ or, if issuing a statement, what position to take. The meeting will also review the progress of investigations into cases in which Yoon Seok-youl, the People Power Party’s presidential candidate, has been named, including the ‘accusation solicitation’ suspicion case and the ‘judge surveillance document’ case. With less than 60 days remaining until the presidential election, there will likely be an exchange of opinions between the investigation team and leadership on whether it is possible to complete the investigations and announce the results before the election.
