Mother Submits Petition Asking for Leniency for Son Who Threatened Her with a Weapon While Drunk
[Asia Economy Reporter Kim Hyung-min] A man in his 50s who was sentenced to prison for threatening his mother with a weapon while intoxicated was released on probation in the appeal trial. This was due to a petition submitted by the mother asking for leniency for her son.
According to the legal community on the 5th, the Criminal Division 13 of the Seoul High Court (Presiding Judges Choi Soo-hwan, Choi Sung-bo, Jung Hyun-mi) overturned the first trial's sentence of 8 months imprisonment for A (50), who was charged with special threats to a family member, special property damage, and public obscenity, and instead sentenced him to 8 months imprisonment with 2 years probation. The order to attend a 40-hour sexual violence treatment program was maintained.
A was prosecuted for threatening his mother with a weapon and damaging store items at the restaurant she operated around 11:30 p.m. in July 2020 after being scolded to "stop drinking." He was also charged with causing a public disturbance by being naked on the road next to the store while heavily intoxicated on the same evening.
The first trial sentenced him to prison and detained him in court, stating, "The defendant has a history of multiple punishments for similar or related crimes, and this crime was committed during a probation period."

However, the second trial accepted A's claim that the first trial's sentence was too harsh and reduced the sentence to probation. The appellate court stated that it considered the victim's petition submitted to the court, A's cooperation with psychiatric treatment after the crime, and the fact that the victim, who has mobility difficulties, requires the defendant's care.
