[Asia Economy Reporter Lim Cheol-young] The Ministry of the Interior and Safety announced on the 9th that it will implement the amended Administrative Scrivener Act, Enforcement Decree, and Enforcement Rules to revitalize the administrative scrivener system starting from the 10th. This amendment reflects the rapidly changing administrative environment and administrative demands since the full revision of the Administrative Scrivener Act in 2011.

The amended law introduces the administrative scrivener corporation system to provide more organized and specialized administrative scrivener services and mandates measures to guarantee liability for damages to strengthen accountability. Corporations can be established and operate by forming a corporation with three or more administrative scriveners, drafting articles of incorporation, and obtaining approval from the Minister of the Interior and Safety along with registration of establishment.

The Ministry of the Interior and Safety explained, "Qualified professionals have provided specialized services through law firms, labor law firms, tax law firms, and judicial scrivener corporations," adding, "This amendment allows administrative scriveners to establish corporations as well, enabling active response to the increasingly complex and diverse administrative environment and rapidly changing administrative demands." Furthermore, to guarantee liability for damages of administrative scrivener corporations, selective measures such as insurance subscription, cash deposits, or government/public bond deposits are required.

To ensure efficient operation of the administrative scrivener system and create conditions for self-regulation, the existing eight administrative scrivener associations have been unified into the ‘Korean Administrative Scrivener Association’ with mandatory membership. Previously, the administrative scrivener associations operated under an approval system, leading to the proliferation of multiple associations and ongoing dissatisfaction with administrative services. Going forward, the Korean Administrative Scrivener Association will actively serve as a single association to enhance the dignity of administrative scriveners and promote improvement and development of their duties.

To enhance the professionalism and capabilities of administrative scriveners, biennial training has been made mandatory. The announcement period for practical training plans and the application period for training have been relaxed to improve convenience for training institutions and applicants, and provisions have been established to allow practical and training education to be conducted online, aligning with the non-face-to-face era.

Additionally, to ensure fair performance of duties by administrative scriveners and increase public trust, the exemption criteria for parts of the administrative scrivener qualification exam have been strengthened. Administrative scriveners who retired from public service are restricted from accepting work related to the institution where they worked from one year before retirement until the time of retirement.

Meanwhile, the Ministry of the Interior and Safety is promoting improvements to the system by newly establishing a system to manage applications for administrative scrivener certificate issuance in line with the changed administrative scrivener system, enabling real-time online issuance through Government24.

Lee Jae-young, Vice Minister of the Ministry of the Interior and Safety, stated, “With the enforcement of the amended Administrative Scrivener Act, we hope the administrative scrivener system will be revitalized so that many citizens can easily and conveniently use administrative services and actively protect their rights and interests.”
