Police Forward Non-Prosecution Opinion on Re-Reported Case of Kim Hak-eui and Yoon Joong-chun's Alleged Villa Sexual Bribery
[Asia Economy Reporter Jeong Dong-hoon] Regarding the case in which the victim refiled a complaint claiming to have been sexually assaulted by former Ministry of Justice Vice Minister Kim Hak-ui and construction businessman Yoon Joong-chun in connection with the 'villa sex entertainment' allegations, the police have forwarded the case to the prosecution with a recommendation for non-prosecution.
On the 28th, according to the police, the Seoul Metropolitan Police Agency's Intelligent Crime Investigation Unit recently sent the case involving former Vice Minister Kim and Mr. Yoon, who were re-accused of special rape charges, to the prosecution with a non-prosecution opinion. The investigation into Mr. Yoon's violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (filming using cameras, etc.) was closed due to the expiration of the statute of limitations, resulting in no prosecution.
The victim's representatives and women's organizations submitted a complaint to the police last December, stating that the prosecution did not indict former Vice Minister Kim and Mr. Yoon for 12 cases of rape and other crimes, and filed charges against the prosecutors who handled the past investigation for abuse of authority. In particular, these groups requested that Kim and Yoon be punished for injury by rape, claiming that the victim developed post-traumatic stress disorder (PTSD) due to the rape by Kim and Yoon.
The 'villa sex entertainment' allegations involve construction businessman Yoon allegedly providing sexual entertainment to high-ranking social figures, including former Vice Minister Kim, around 2006 at a luxury villa in Wonju, Gangwon Province, among other locations. A police official stated, "After comprehensively reviewing recent court rulings and investigation details, it was judged that the charges were difficult to prove, so the case was forwarded with a recommendation for non-prosecution."
The police are understood not to have separately summoned former Vice Minister Kim and Mr. Yoon for investigation.

The Supreme Court confirmed the original sentence on the 26th of last month, sentencing Mr. Yoon to 5 years and 6 months in prison. However, the sexual crime charges were dismissed or acquitted due to reasons such as the expiration of the statute of limitations. The Supreme Court upheld the second trial's judgment that "the causal relationship between special rape, etc., and post-traumatic stress disorder is not recognized."
