"Partial Indirect Enforcement Application by Some 'Boammo' Members Granted"... Must Compensate 1.4 Million KRW Each Protest
Court Approves Indirect Compulsory Measures Application Against Some Members of Boammo Rally
[Asia Economy Reporter Oh Hyung-gil] An indirect coercive order has been issued against members of the "Cancer Patients' Group Responding to Insurance Companies (Boammo)" who are conducting illegal protests at the Samsung Life Seocho Building. If they continue to protest, they will have to compensate Samsung Life.
According to the legal community on the 5th, the Seoul Central District Court recently approved the indirect coercive application filed by Samsung Life and other Samsung financial affiliates, as well as two Samsung daycare centers located in the Samsung Electronics Seocho Building, against the Boammo gatherings.
Accordingly, Boammo members must pay an indirect coercive fine of 1.4 million KRW per incident: 500,000 KRW each to the daycare center directors and 100,000 KRW each to the Samsung financial affiliates. The indirect coercive fine is a type of penalty imposed when a court order is not complied with and is a means of compulsory execution under civil law.
Despite the court's injunction issued in August prohibiting obstruction of business, Boammo has continued illegal protests.
From now on, acts such as delivering speeches or playing audio claiming that Samsung Life defrauded customers using banners, speakers, etc., causing noise at 75 decibels (db) during the day and 65 db at night, or playing funeral music are prohibited.
Acts such as using abusive language or playing audio containing such content, occupying passageways in each building of the Seocho Building, or obstructing passage with vehicles or containers are also prohibited.
