Samsung Life Insurance Wins Lawsuit on Cancer Hospitalization Fees at Nursing Hospitals
[Asia Economy Reporter Lim Chun-han] The defendant Samsung Life Insurance's victory was confirmed in a lawsuit filed by the representative of a cancer patient group demanding payment for cancer hospitalization fees.
According to Samsung Life Insurance on the 5th, on the 24th of last month, the Supreme Court dismissed the appeal without review in the lawsuit filed by Lee Jeong-ja, co-representative of the 'Cancer Patients Association Against Insurance Companies (Boammo),' demanding payment for cancer hospitalization fees. An appeal dismissal without review is a system where the Supreme Court rejects the appeal without substantive review, judging that there is no special reason such as a violation of law in the lower court's decision.
Previously, Representative Lee filed a lawsuit against Samsung Life Insurance demanding payment for cancer hospitalization fees for treatment in a nursing hospital but lost in both the first and second trials. The lower court ruled that Lee's nursing hospital treatment was not directly related to cancer treatment and therefore did not constitute grounds for payment of cancer hospitalization fees under the policy terms, siding with Samsung Life Insurance. Representative Lee is preparing to request a retrial as she cannot accept the Supreme Court's decision.
