On the 12th, at the Daejeon District Court's 11th Criminal Division (Presiding Judge Kim Yongchan), during the sentencing hearing for violations of the Special Act on the Punishment of Sexual Crimes, the prosecution requested 15 years imprisonment for Mr. A, who was charged with instigating rape, and 7 years imprisonment for Mr. B, who was charged with residential intrusion and rape. They also requested public disclosure of personal information and a 10-year employment restriction order for child and youth-related institutions.
The prosecution explained, "The victim opened the door due to a coincidental circumstance that an acquaintance was supposed to come, but the unfamiliar Mr. B pushed her neck without any words and dragged her inside the house to rape her. The fear, anxiety, sexual shame, and self-loathing the victim must have felt are unimaginably severe."
They added, "The defendants committed the crime despite knowing the victim would suffer such pain, showing a bad nature of the crime and a clear lack of general respect for human dignity," explaining the reason for the sentencing request.
Mr. A's defense attorney argued, "Mr. A never instructed Mr. B to commit rape; it was a role-play scenario. The victim happened to open the door, leading to the rape, but Mr. A did not foresee the actual crime occurring."
Mr. B's defense attorney claimed, "Mr. B was completely deceived by Mr. A and did not anticipate what happened. There was no intent to commit rape, and Mr. B was used as a tool."
Mr. A stated, "I will live with heightened awareness of chat apps due to this incident," and added, "I will try to help heal the victim's emotional wounds."
Mr. B expressed, "I sincerely apologize to the victim."
The sentencing hearing for these individuals is scheduled for 2 p.m. on June 4.
Previously, the prosecution indicted Mr. A on charges of instigating residential intrusion and rape under the Special Act on the Punishment of Sexual Crimes, and Mr. B on charges of residential intrusion and rape under the same law.
Last August, Mr. A created a profile as a "35-year-old woman" on a chat app that randomly connects users with unspecified others and posted a message saying, "I want to be raped. Looking for a man to role-play."
While continuing conversations with Mr. B, who showed interest in his post, Mr. A gave him the address of a one-room apartment, pretending to live there.
Believing Mr. A's words, Mr. B forcibly entered the one-room apartment in Sejong City using his car and sexually assaulted the woman living there.
The victim was a person unknown to both Mr. A and Mr. B.
