Daycare Director's Husband Who Installed Hidden Camera in Staff Restroom Faces Three-Year Prison Term
Indicted and Detained for Illegally Filming 12 Staff Members
Fled After Disposing of SD Card Containing Evidence
The prosecution has requested a three-year prison sentence for a man in his 40s who was brought to trial on charges of illegally filming 12 staff members, including female teachers, by installing a small camera in a staff restroom at a daycare center operated by his wife.
According to Yonhap News Agency on April 23, during a final hearing presided over by Judge Ji Sun-kyung of the 11th Criminal Division of the Suwon District Court, the prosecution asked the court to sentence Mr. A, who is in his 40s and was indicted and detained on charges of violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (filming using a camera, etc.), to three years in prison.
The prosecution also requested that the court order Mr. A to complete a sex offender treatment program, impose a 10-year employment restriction, and require disclosure and notification of his personal information.
The prosecution stated, "As the daycare director, the defendant repeatedly committed crimes over a considerable period against employees he was supposed to protect, which makes the nature of the crime extremely grave. The method of the crime became more audacious, as he modified a camera placed on a restroom shelf to install it in a toilet, and he also destroyed evidence after being caught, which was taken into consideration."
Mr. A's side admitted to all charges but appealed for leniency. Mr. A's attorney argued, "The defendant fully acknowledges his wrongdoing and is deeply remorseful. Furthermore, forensic analysis confirmed that the victims' greatest concern—distribution or copying of the footage—did not occur at all."
The attorney also requested that the court consider the substantial blow to the family's livelihood, as the daycare center has effectively closed following the incident. The attorney added, "Although the defendant has not been forgiven by the victims, his family is committed to strictly supervising and guiding him properly in the future, and we ask the court to take this into account."
Previously, Mr. A was indicted and detained on charges of illegally filming 12 staff members, including female teachers, by installing a small camera in the staff restroom on the first floor of a daycare center in Yongin City from early August to December 9 of last year. The daycare center in question is operated by Mr. A's wife, and Mr. A was reportedly working there as a chauffeur.
During the investigation, evidence of attempted destruction of evidence also emerged. Mr. A delayed reporting to the police for several days despite requests from teachers who discovered the camera in the restroom, and instead tried to erase evidence by entrusting a private company with a forensic analysis. He is also accused of flushing the SD card containing evidence down the toilet, fleeing to Donghae City in Gangwon Province, and discarding the camera and other devices used in the crime into the sea.
