In a case where a non-lawyer was prosecuted for pretending to be a legal professional, drafting civil litigation documents, and receiving a leased Mercedes-Benz vehicle and cash in return, the Supreme Court upheld the lower court's decision, finalizing the sentence of a fine and forfeiture.
According to the legal community on December 10, the Supreme Court's Second Division (Presiding Justice Kwon Youngjun) dismissed the defendant's appeal on charges of violating the Attorney-at-Law Act and upheld the previous ruling, which imposed a fine of 2 million won and ordered the forfeiture of approximately 12.88 million won.
The defendant, who was employed at a law firm between 2017 and 2019, approached a small business by introducing himself as "a lawyer who handles all legal matters in the Gyeonggi Province area." He personally drafted legal documents that only lawyers are authorized to prepare, such as a withdrawal of appeal and an application to amend the claim, and had the company's representative submit them to the court.
He also received compensation. He was provided with a leased Mercedes-Benz E200, which he used for about six months, and a third party paid the lease fee amounting to 15.65 million won. After drafting documents for another civil case, he received 900,000 won in cash.

The first trial found the defendant guilty on all charges and sentenced him to a fine of 3 million won and forfeiture of 16.55 million won. However, the appellate court acquitted him of the 900,000 won cash charge, reducing the fine to 2 million won and the forfeiture to 12.88 million won. The Supreme Court stated, "The lower court's evaluation of the evidence does not contradict logic or common sense," and dismissed the appeal, thereby finalizing the fine and forfeiture imposed by the lower court.
