Taking Out Loans Using Wife's Name Without Permission
A court ruling has been issued to annul a marriage with a spouse who lied about their name, occupation, and other details from dating through marriage.
On the 17th, the Gyeongju Branch of Daegu Family Court ruled in a marriage annulment lawsuit filed by Ms. A (36) against her husband Mr. B (51), stating "The marriage between the plaintiff and defendant is annulled."
Ms. A and Mr. B met through a mobile game. At that time, Mr. B told Ms. A, "(I am) a former member of the Republic of Korea Special Forces Intelligence Unit and cannot reveal my face or open a bank account under my name," claiming "everything is confidential."

View original imageHowever, after marriage, when Ms. A checked Mr. B’s personal information, it was revealed that all details on the marriage registration and birth registration?including Mr. B’s name, age, first marriage status, children, family relations, and military service history?were lies. Furthermore, Mr. B had also used Ms. A’s identity to take out loans in her name.
He is also accused of repeatedly assaulting Ms. A while she was pregnant. It is reported that Ms. A filed a criminal complaint against Mr. B. Mr. B disappeared afterward but was arrested and imprisoned after becoming a wanted person.
Ms. A sought help from the Korea Legal Aid Corporation to annul the marriage on grounds of fraud and to obtain sole custody and parental rights of the child. The corporation filed the annulment lawsuit on behalf of Ms. A against Mr. B. The corporation argued that if Mr. B had not actively deceived Ms. A at the beginning of their relationship, she would not have married him, constituting grounds for annulment.
They also added that considering Mr. B’s violent behavior and the dangerous situation that could cause significant financial damage, sole custody and parental rights of the child should be granted to Ms. A.
In response, Mr. B claimed in court that "the child is not his but was fathered by another man with whom Ms. A had an affair," but DNA testing confirmed the child is Mr. B’s biological offspring.

The court accepted all of the corporation’s claims, annulled the marriage between Ms. A and Mr. B, and granted sole custody and parental rights of the child to Ms. A.
