Prosecutor Sentenced to 5 Years in Prison Appeals First Trial Verdict
"Tried to Take Victim's ID to Prevent Report"
A man in his 20s was sentenced to five years in prison for sexually assaulting a woman who had fallen asleep after drinking at an unmanned photo studio in a busy area of Seoul. The prosecution appealed, stating that a harsher punishment is necessary.
According to the legal community on the 29th, the Criminal Division 11 of the Seoul Western District Court (Chief Judge Bae Seong-jung) sentenced Mr. A to five years in prison on the 19th on charges including rape causing injury.
According to the prosecution, Mr. A was tried on charges of dragging the intoxicated victim who had fallen asleep into a photo booth at an unmanned photo studio in Seogyo-dong, Mapo-gu near Hongdae in September last year, sexually assaulting her, and strangling her, causing injuries such as cervical sprain. Mr. A also took the victim’s resident registration card to prevent her from reporting the crime.
The police received the victim’s report and urgently arrested Mr. A in Bucheon, Gyeonggi Province, 12 hours after the crime, and conducted an investigation.
Earlier, the prosecution requested the court to sentence Mr. A to 10 years in prison. However, the court sentenced him to five years on the 19th.

The prosecution explained the reasons for the appeal, stating, "Considering that it was a premeditated crime against the victim, the heavy responsibility and high blameworthiness for raping the victim in an unmanned photo studio accessible to anyone, the unfavorable circumstances after the crime such as taking the victim’s resident registration card to identify her personal information and prevent reporting, and the fact that the victim has not forgiven him."
