Former U.S. President Donald Trump has appealed to the U.S. Supreme Court against the Colorado Supreme Court ruling that disqualified him from running in the presidential election. This comes just one day after he filed a lawsuit to overturn Maine's decision to block his presidential bid. With the Republican Party entering the primary season this month ahead of the November election, Trump's fate now hinges on the Supreme Court's judgment.
On the 3rd (local time), according to U.S. media including The New York Times (NYT), Trump submitted an appeal to the U.S. Supreme Court requesting the invalidation of the Colorado Supreme Court ruling.
Trump's legal team stated in the petition, "The Colorado Supreme Court's ruling is incorrect and cannot be correct," adding, "The judiciary has prevented voters from voting for the major party presidential candidate." They further emphasized, "All issues should be resolved by Congress, not the judiciary," and "The Colorado Supreme Court is infringing on the authority of Congress."
Earlier, on the 19th of last month, the Colorado Supreme Court became the first U.S. court to rule that former President Trump was ineligible to run in the state's presidential primary, citing his incitement of the January 6 Capitol riot. The court found that Trump had encouraged supporters to riot at Congress in January 2021 in an attempt to overturn his election defeat. This decision was based on the 14th Amendment, which prohibits public officials who participated in insurrection from holding office again. Following the Colorado Supreme Court, Maine Secretary of State Shenna Bellows also decided to exclude Trump from the state's primary ballot. In response, Trump filed a lawsuit the previous day at the Kennebec County Superior Court challenging Maine's decision.
However, until the Supreme Court issues a ruling, the Colorado Supreme Court's decision will not take effect. Therefore, Trump's name will remain on the state primary ballots for the time being.
This appeal to the Supreme Court marks a significant turning point in the controversy over Trump's eligibility to run for president. If the Supreme Court sides with Trump, it will put an end to the dispute. Conversely, if the Court rejects Trump's claims, the controversy surrounding his eligibility is expected to escalate uncontrollably.
Despite the increasing 'judicial risk' as Trump's fate depends on the judiciary's decision, his popularity among Republican voters is rising as the party begins its primary season starting with the Iowa caucuses on the 15th. Currently, aside from the eligibility controversy, Trump faces criminal charges in four cases involving 91 counts, with trials forthcoming.
According to a recent poll by U.S. polling firm FiveThirtyEight, Trump holds 50% support among Republican voters. Following him are Florida Governor Ron DeSantis with 18.4% and former U.N. Ambassador Nikki Haley with 15.7%. In a hypothetical head-to-head matchup against incumbent President Joe Biden, Trump leads with 40% to Biden's 36%, a 4 percentage point advantage.

Trump's camp has intensified criticism, accusing President Biden and the Democratic Party of election interference. Steven Cheung, a spokesperson for Trump's campaign, stated, "Biden's crooked and dishonest allies are attempting to exclude former President Trump, the leading candidate for the 2024 election, from the primaries," adding, "They are doing everything they can to strip all American voters of their right to vote."
