Former Representative Song Young-gil's Detention Hearing Today... Outcome Depends on Evidence Presentation and Concerns Over Evidence Tampering
The warrant hearing for Song Young-gil, former leader of the Democratic Party, who has been indicted on allegations related to the Democratic Party convention money envelope scandal and illegal political fund receipt through an external support organization, will be held on the 18th.
Whether Song will be detained depends on how the prosecution proves that Song was aware of the distribution of money envelopes during the party leadership election process, and whether the court recognizes the risk of evidence destruction, such as coordinating statements with involved parties.

Earlier, on the 13th, the Anti-Corruption Investigation Division 2 of the Seoul Central District Prosecutors' Office (Chief Prosecutor Choi Jae-hoon) filed an arrest warrant request against Song on charges including violation of the Political Parties Act and Political Funds Act, and bribery under the Act on the Aggravated Punishment of Specific Crimes, related to the Democratic Party convention money envelope scandal and donations received from the external support organization 'Peace and Livelihood Issues Research Institute (Meoksa-yeon)'.
Song is accused of being involved in the distribution of money envelopes totaling 66.5 million KRW to Democratic Party lawmakers and regional headquarters chiefs during March to April 2021, ahead of the party convention. Additionally, he is charged with receiving a total of 763 million KRW in illegal political funds from seven individuals through Meoksa-yeon between January 2020 and December 2021. Among these, the 40 million KRW received from Park Yong-ha, former chairman of the Yeosu Chamber of Commerce and Industry, in July to August 2021 is also subject to bribery charges.
Since Song has strongly denied the related allegations, a fierce confrontation between Song’s side and the prosecution is expected during the warrant hearing.
Regarding the allegations related to the money envelope scandal (violations of the Political Parties Act and Political Funds Act), the outcome will likely depend on whether the prosecution can refute Song’s claim that he was completely unaware of the money envelope distribution through testimonies or evidence from related parties.
However, Song’s attitude of downplaying the money envelope distribution during the party’s internal election as an internal party matter, suggesting it was not a significant issue, is expected to leave a negative impression on the court. Furthermore, recent unfavorable testimonies against Song by related parties who have been indicted in connection with the money envelope scandal are also expected to work in favor of the prosecution.
Regarding the illegal political fund receipt through Meoksa-yeon, since Song’s side has maintained that there were no accounting issues, a fierce legal battle over violations of the Political Funds Act is anticipated.
Since Song’s residence is stable and there is no concern about flight risk, if the allegations are somewhat substantiated, the court’s decision on the necessity of detention will likely hinge on the risk of evidence destruction.
The prosecution is expected to emphasize the necessity of detention by highlighting that Song replaced his previously used mobile phone upon returning from France and submitted it to the investigation team, and that there are indications he used a registered phone under another name to monitor the investigation and persuade related parties.
Song’s detention decision is expected to influence not only the investigation into current Democratic Party lawmakers who received money envelopes but also the broader investigation into other Democratic Party figures.
If Song is detained, the Democratic Party’s criticism that the prosecution is conducting a politically motivated 'targeted investigation' will lose credibility, and the prosecution is likely to accelerate investigations into the 20 current lawmakers who received money envelopes.
On the other hand, if the arrest warrant for Song is dismissed following the dismissal of the warrant for Democratic Party leader Lee Jae-myung, the prosecution is expected to face criticism of conducting an 'excessive political planned investigation,' which will inevitably hamper future investigations.
Judge Yoo, who will decide on Song’s detention, is expected to conduct the hearing with a heavier burden than any other case.
Previously, in September, Judge Yoo dismissed the arrest warrant requested by the prosecution against Lee Jae-myung on charges of bribery related to the Baekhyun-dong development and remittance to North Korea, and perjury coaching in violation of the Public Official Election Act.
At that time, Judge Yoo stated, "The perjury coaching charge appears to be substantiated," but dismissed the warrant for Lee on other charges citing disputes over the allegations or the fact that evidence had already been secured, which sparked controversy.
Especially after the warrant dismissal, conservative civic groups hung large banners with Judge Yoo’s face and the phrase 'political judge' around Seocho-dong and Gangnam Station areas, and the Court Administration Office even filed a police complaint against those civic groups.
From Judge Yoo’s perspective, dismissing Song’s warrant as well could lead to even harsher attacks from conservative groups, labeling him a 'leftist judge.' Conversely, if he issues the warrant, he must endure being targeted by Democratic Party supporters, especially the hardline faction known as Gaeddal (Daughters of Reform).
Since Judge Yoo will face political attacks regardless of his decision, he is expected to strictly judge the necessity of detention from a legal standpoint and based on the evidence presented, clearly stating the reasons.

Song’s detention decision is expected to be announced as early as late afternoon on the same day or in the early hours of the 19th. During the warrant hearing for Lee Jae-myung, Judge Yoo communicated the dismissal decision along with a lengthy 793-character explanation, including spacing, to the press officer around 2:23 a.m., past midnight.
