Mr. A is accused of stabbing his sleeping girlfriend multiple times with a weapon in the early morning of December 2022, causing her death. Mr. A had been in a relationship with the deceased girlfriend since around 2008, with marriage as the premise.
During their 14 years together, Mr. A believed that his deceased girlfriend worked as a contract public official at the community service center and city hall, but upon learning that she actually worked serving drinks to male customers at a hof bar, he felt anger and betrayal.
Later, while drinking with his girlfriend, they had an argument. After she fell asleep, Mr. A decided to kill her and committed the crime.
During the trial, Mr. A claimed he was in a state of diminished mental capacity at the time of the crime. He stated, "After hearing religious talks from my girlfriend, I experienced hallucinations and auditory hallucinations," and "At the time of the incident, I was terrified because I believed my girlfriend was conspiring with others to harm and kill me, and I heard voices commanding me to kill her, so I did."
However, the court judged that Mr. A was not in a state of diminished mental capacity at the time of the crime, based on the circumstances and method of the crime and the results of the psychiatric evaluation.
The court stated, "The defendant stabbed the victim, who was lying down, multiple times with a weapon, indicating a very definite intent to kill," and added, "Violating the irreplaceable and precious value of human life is a serious crime that cannot be remedied by any means."
