Court Recognizes Jeong Jin-seok's Execution of Duties... "No Issues with Standing Committee Resolution"

View original image[Asia Economy Reporter Yoo Byung-don] Former People Power Party (PPP) leader Lee Jun-seok filed an injunction to suspend the effectiveness of the emergency response committee led by Jeong Jin-seok, but the court dismissed all of his requests.
The Civil Division 51 of the Seoul Southern District Court (Chief Judge Hwang Jeong-su) on the 6th dismissed all injunction applications filed by former leader Lee against Emergency Response Committee Chairman Jeong Jin-seok and six committee members seeking suspension of their duties.
The court also dismissed the injunction to suspend the effectiveness of the PPP's party constitution amendment, which added the resignation of four or more of the five elected Supreme Council members as a condition for an 'emergency situation,' approved at the national committee meeting.
The court stated, "It is difficult to find any substantive or procedural defects in the PPP's national committee resolution on September 8 based on the amended party constitution," and added, "There is no legal defect in the launch of the PPP emergency response committee according to the amended party constitution."
Earlier, on the 28th of last month, the court concluded hearings on the third to fifth injunctions, including the suspension of the effectiveness of the 'emergency situation' party constitution amendment at the national committee (3rd), suspension of Chairman Jeong Jin-seok's duties (4th), and suspension of duties of six emergency response committee members (5th).
After the injunction suspending former Emergency Committee Chairman Joo Ho-young's duties was accepted, the PPP amended the party constitution to require the resignation of four out of five elected Supreme Council members as a condition for establishing an emergency response committee and re-launched the 'Jeong Jin-seok emergency committee,' leading to a legal dispute over the legitimacy of this procedure.
Former leader Lee's position is that the party constitution amendment allowing the Supreme Council to be converted into an emergency response committee if four or more elected Supreme Council members resign violates the principle of non-retroactivity. He also argued that since the court had already suspended former Chairman Joo Ho-young's duties, the appointment of a new emergency committee chairman is invalid.
However, as the court did not accept any of Lee's injunctions, the Jeong Jin-seok emergency committee system has been firmly established.
Meanwhile, the PPP Ethics Committee will begin additional disciplinary deliberations at 7 p.m. today regarding Lee's strong criticisms targeting President Yoon Seok-youl and the pro-Yoon faction, including remarks such as 'yangduguyuk' (a Chinese idiom meaning 'a dog’s head with a tiger’s body') and 'new military regime.' Many expect that the additional discipline will result in severe penalties such as expulsion or recommendation to leave the party.

Lee's side sharply criticized the Ethics Committee's summons and request for explanation as unconstitutional and illegal due to procedural violations, including failure to meet the deadline for submitting opinions. They also hinted at filing a sixth injunction if additional disciplinary action is taken.
