"30-Year-Old Accused of Stalking for 'No Words About Breaking Up'... Prosecution Seeks 2-Year Prison Sentence"
[Asia Economy Reporter Oh Gyumin] The prosecution has requested a two-year prison sentence for a woman in her 30s who is accused of asking a locksmith to open the front door and sending text messages on a mobile phone because her ex-boyfriend did not say he wanted to break up.
On the 6th, the trial of A (32), who is charged with violating the Act on the Punishment of Stalking Crimes, was held under the presiding of Judge Jang Young-chae of the Criminal Division 2 at the Seoul Western District Court.
According to the prosecution, despite receiving a provisional measure decision from the court in April, A is accused of stalking her ex-boyfriend B 45 times from May by calling him or sending text messages. She is also accused of asking the security guard to open the shared entrance of B’s residence under the pretext of “delivering food” or requesting a locksmith to damage the front door of B’s house.
Under the Act on the Punishment of Stalking Crimes, a provisional measure is a decision made by the court upon request by the prosecutor when there is a concern of crime recurrence, including written warnings to stop stalking, prohibition of approaching within 100 meters, and prohibition of approaching via telecommunications.
A’s defense attorney stated in the final argument, “A acted immaturely, thinking only of herself without considering the victim’s position at the time,” and added, “She is deeply reflecting while spending time in detention and is currently suffering from mental illnesses such as depression.”
A also said, “The crime occurred because B did not communicate the breakup,” and “I regret meeting B from the beginning, will erase him from my mind, and have deeply regretted and reflected while in detention.” She continued, “I will live without harming others and obey laws and rules well, and I did not think of myself as the most precious,” asking for leniency.
