The 11th Criminal Division of the Gwangju District Court (Presiding Judge Park Hyun-su) announced on the 23rd that it sentenced Mr. A (59 years old), who was indicted for violating the Act on the Aggravated Punishment of Specific Crimes (retaliatory threats, etc.), confinement causing injury, and violation of the Animal Protection Act, to two years in prison.
On September 24 last year, around 9:50 p.m., Mr. A assaulted his neighbor Mr. B (28 years old) in front of a multi-family housing complex in Gwangju after Mr. B told him to put a muzzle on his Pitbull Terrier. A week later, Mr. A retaliated by threatening Mr. B in the hallway, saying, "I will have my dog bite you to death," because Mr. B had reported him to the police. He also damaged the front door of Mr. B’s house and threatened to harm Mr. B’s family.
Between October 4 and 5 last year, Mr. A’s dangerous dog attacked two Jindo dogs in a parking lot in Gwangju. One of the Jindo dogs died, and the other was injured in the process.
Investigations revealed that Mr. A often took his dangerous dog for walks, allowing it to attack other dogs, and recorded the fights on his mobile phone.
On October 12 last year, around 6 p.m., Mr. A forced Mr. C (89 years old), who was exercising alone on a walking trail near a reservoir in Gwangju, into his car, confined him when Mr. C demanded to get out, and beat him multiple times. Mr. A is also accused of repeatedly failing to pay for vehicle gas refills and meals or committing theft during the same month.
During the investigation and trial, Mr. A claimed mental illness including alcohol use disorder and diminished mental capacity. However, based on the psychiatric evaluation, the court found no evidence that Mr. A was incapable of distinguishing reality or making decisions, and thus rejected his claims.
