Samsung Electronics Files Counterclaim Against Former Executive in Patent Lawsuit: "Confidentiality Breach and Breach of Good Faith"

View original image[Asia Economy Reporter Lee Hye-young] It has been confirmed that Samsung Electronics filed a countersuit against a former executive who had filed a patent lawsuit against the company.
According to industry sources on the 14th, Samsung Electronics filed a complaint on the 10th (local time) at the U.S. Eastern District Court of Texas, claiming trade secret theft and other charges against the patent asset management company (NPE) 'Synergy IP' and the audio and wireless communication specialist company 'Stayton Tekiya LLC.'
The lawsuit names former Synergy IP CEO Ahn Seung-ho, who previously served as the head of the IP Center (Vice President) at Samsung Electronics, and former executive director Jo, who was an in-house lawyer, as defendants along with these companies.
Earlier, in November last year, Synergy IP and Stayton Tekiya filed a patent lawsuit against Samsung Electronics and Samsung Electronics America in the same court. They claimed that Samsung Electronics infringed on more than ten patents related to wireless earphones and voice recognition.
In this countersuit, Samsung Electronics refutes Synergy IP’s patent infringement claims and argues that they committed various illegal acts such as trade secret theft, breach of duty of good faith, and illegal conspiracy.
Regarding the trade secret theft claim, Samsung Electronics asserts that CEO Ahn and former executive Jo had access to core patent-related information while serving as head of the IP Center and in-house lawyer, respectively, and that they are abusing the confidential information obtained during that time in the lawsuit after their resignation. The company also pointed out that this lawsuit violates the duty of good faith to protect trade secrets acquired during their tenure.
Additionally, Samsung Electronics stated that CEO Ahn, former executive Jo, and the two companies conspired in advance with the intent to demand excessive royalties and filed this lawsuit against Samsung Electronics, constituting illegal conspiracy under civil law.
In particular, Samsung Electronics revealed that CEO Ahn had already planned to engage in patent-related business while still employed and actually established a patent company in July 2019, before his resignation, presenting related evidence to the court.
CEO Ahn, a patent attorney with an engineering background, joined Samsung Electronics in 1990 and served as head of the IP Strategy Team and Licensing Team at the Comprehensive Technology Institute before leading the IP Center from 2010 to 2019.
