View original image[Asia Economy Reporter Lim Juhyung] The first trial was held for a man in his 30s who was diagnosed with AIDS (Acquired Immunodeficiency Syndrome) and charged with sexually assaulting his biological daughter.
The 11th Criminal Division of Daegu District Court conducted the trial on the morning of the 4th for Mr. A (39), who was indicted for violating the Sexual Violence Punishment Act and the AIDS Prevention Act.
According to the prosecution, Mr. A sexually abused his daughter, Ms. B, who was 8 years old at the time, by forcibly molesting and raping her a total of four times over about one month from February to March 2019 at their home in Dong-gu, Daegu.
At the time of the crimes, Mr. A had been diagnosed with infection by the Human Immunodeficiency Virus (HIV), the cause of AIDS. He was also charged with repeatedly transmitting the virus by raping his daughter despite knowing this fact. HIV can be transmitted through mucous membrane contact during sexual intercourse or through wounds entering the other person's body.
Accordingly, under the current AIDS Prevention Act, an infected person who engages in acts that transmit the virus can be sentenced to up to three years in prison.
Fortunately, Ms. B tested negative for HIV in a test conducted last December.
During the trial, Mr. A's legal representative admitted to "generally acknowledging the charges" but stated, "There are some details that differ from the facts. Verification is necessary."
In response, the court requested, "If the defendant's side intends to dispute the charges in the future, please consider that the victim, who is the defendant's biological daughter, may appear in court."

The next trial is scheduled to be held at Daegu District Court on March 11.
