Assemblyman Kim Hoe-jae's Seminar on 'Authoritarian Administrative Investigations and Rule of Law Controls' Successfully Concluded

Will Develop Legislative Alternatives for Fair and Transparent Due Process
[Asia Economy Honam Reporting Headquarters, Reporter Heo Seon-sik] A forum titled “Authoritarian Administrative Investigations and Rule of Law Control” jointly organized by Kim Hoe-jae, a member of the Democratic Party of Korea (Yeosu-eul, Jeonnam), and the Korean Criminal Procedure Law Association was held on the 13th at the National Assembly Members’ Office Building.
The forum was arranged to discuss effective legal control measures in response to criticisms that institutional mechanisms to check the authoritarian administrative investigation powers held by quasi-judicial bodies such as the National Tax Service and the Fair Trade Commission are insufficient.
Experts representing the legal community, academia, business sector, and media participated in the forum to deeply discuss issues and solutions related to the administrative investigations and procedures of the National Tax Service and the Fair Trade Commission.
In his opening remarks, Representative Kim Hoe-jae explained the purpose of the forum regarding the National Tax Service, stating, “While it plays a pivotal role in securing national financial resources, controversies over the procedural legality of tax investigations and continuous demands for fair and transparent tax administration have been raised.”
Regarding the Fair Trade Commission, he said, “The Fair Trade Commission, established to ensure fair competition among companies, uphold consumer sovereignty, and prevent monopolies, faces criticism that it fails to perform its functions properly due to excessive concentration of power without checks.”
Professor Jung Woong-seok, president of the Korean Criminal Procedure Law Association, said, “Although the National Tax Service and the Fair Trade Commission have greatly contributed to surpassing advanced countries in tax administration and fair competition, administrative investigations have remained within the scope of judicial control under the perception that they are not criminal investigations,” adding, “I hope that today’s discussion will lead to effective rule-of-law control measures for authoritarian administrative investigations.”
Representative Kim stated, “I expect the National Tax Service to strongly support rapid and robust economic recovery and stabilization of the people’s economy through fair, transparent, and lawful tax administration, and the Fair Trade Commission to become an institution that leads the creation of a market ecosystem where consumers’ rights are protected and small and medium enterprises and small business owners can conduct economic activities with confidence,” and added, “Based on the valuable insights shared at this forum, I will take the lead in policy changes through legislation at the National Assembly level.”
