Smartwatch Use During Specialist Exam... Court Rules "Exam Restriction Lawful"
[Asia Economy Reporter Seongpil Cho] A doctor who was caught taking the specialist qualification exam while wearing a smartwatch filed a lawsuit seeking to cancel the restriction on eligibility to take the exam, but the request was denied.
According to the legal community on the 2nd, the Seoul Administrative Court Administrative Division 1 (Presiding Judge An Jonghwa) ruled against doctor A in the lawsuit filed against the Korean Medical Association to cancel the restriction on eligibility to take the specialist qualification exam. The court stated, "Considering the public interest in preventing cheating using electronic devices that are difficult to detect in advance and ensuring the fairness of the exam, the cancellation of eligibility cannot be deemed illegal."
In February of last year, A took the specialist qualification exam while wearing a smartwatch with text message reception functionality. During the exam, the proctor discovered this and removed A from the exam room based on relevant regulations. The Korean Medical Association, which administered the exam, concluded that A's actions constituted cheating, invalidated the exam, and restricted A's eligibility to take the exam for the next two years.
A filed a lawsuit in protest of this decision. He claimed, "It is true that I wore the watch, but I never used it to cheat, and I did not receive any prior explanation from the proctor." He also argued, "I was wearing a sports smartwatch with no call function, and the phone linked to the watch was turned off and submitted, so it is difficult to consider it a communication device."

However, the court rejected A's claims, stating, "Considering technological advancements, it is necessary to prohibit carrying communication devices that could potentially be used for cheating, not only when they are actually used to cheat, and to impose sanctions if violated." The court also pointed out that the prohibition of communication devices was clearly posted on the exam admission ticket and on the blackboard in the exam room, and did not accept A's other arguments.
