[Asia Economy Reporter Han Jinju] The Seoul Metropolitan Office of Education is improving the administrative adjudication system to protect student human rights and citizen rights. They plan to expand oral hearings and actively utilize the participation of third parties in adjudications.
On the 21st, the Seoul Metropolitan Office of Education announced the '2022 Comprehensive Operation Plan for the Administrative Adjudication Committee.'
The Seoul Metropolitan Office of Education will promote ▲public recruitment of administrative adjudication committee members ▲a two-track strategy for adjudication meetings combining regular sessions and intensive hearing periods ▲establishment of case review standards and use of standard review forms ▲operation of both one-case-one-chief-judge and multiple-chief-judge systems ▲strengthening oral hearings, adjudication participation, and expansion of court-appointed representative support ▲introduction of specialized committee members by field.
They will provide active opportunities for citizens and students to testify and expand the participation of third parties with interests in the adjudication. The adjudication participation system allows third parties with interests in the administrative adjudication results to participate by application or ex officio.
The Seoul Metropolitan Office of Education explained, "Recently, as students who are victims of school violence can also file claims, it is expected to help resolve conflicts and disputes between parties involved in school violence."
They will also establish a two-track strategy for adjudication meetings by regularizing the Administrative Adjudication Committee and operating intensive hearing periods. While operating a one-case-one-chief-judge system, in cases where there are multiple interested parties or complex legal issues, two or more chief judges will be appointed.
Additionally, the Office of Education plans to consider introducing a specialized committee system that appoints chief judges by specialty fields for matters related to school violence, protection of teachers' rights, information disclosure, and dispositions related to academies and private institutes.
