[Asia Economy Reporter Yoon Seul-gi] A mother in her 40s who was sentenced to prison in the first trial for leaving her young siblings in a house filled with garbage and infested with bugs for a long period was released on probation in the appeal trial.
On the 19th, the 3rd Criminal Appeal Division of the Incheon District Court (Presiding Judge Han Dae-gyun) announced that it overturned the original sentence of 2 years imprisonment for A (43), who was charged with child abandonment and neglect under the Child Welfare Act, and instead sentenced her to 2 years imprisonment with 3 years probation.
The appellate court also ordered A to undergo probation supervision, complete 120 hours of child abuse recidivism prevention lectures, and restricted her from working at child-related institutions for 3 years.
The appellate court stated, "The defendant left the children she was raising alone in a house filled with piles of garbage and infested with bugs, neglected them, and did not properly provide meals or medical treatment. As a mother, she placed the children in great danger, showing a very poor nature of the crime, yet she showed an attitude of evading responsibility in the first trial."
However, the court explained the sentencing decision by saying, "The defendant restored her relationship with her mother and other family members during the appeal trial, pledged to take responsibility for the children with their help, and showed remorse for her wrongdoing. Considering that this is her first offense and that she was detained for a considerable period, the sentence was mitigated."
A is accused of neglecting her children B (12) and C (6) at a residence in Yangcheon-eup, Gimpo-si, Gyeonggi-do, from October to December last year.
At the time of discovery, C was in such poor health that she could not stand, was malnourished, and had not even received basic vaccinations.
Investigations revealed that A, a freelance writer, had been away from home for a long time since October last year to write promotional articles for local governments in other regions, occasionally returning home to check on the children before going back to work in the provinces.
In the first trial, A stated, "I divorced my husband right after childbirth and raised the older child alone. I gave birth to my second daughter as a single mother (with another man). I hid this fact from my parents, so it was difficult to ask for their help in raising the children."

The prosecution demanded a 5-year prison sentence, but when the first trial sentenced her to less than half of that, they appealed, claiming the sentence was unfair. A also appealed, arguing the sentence was too harsh.
