A (36, female), living in an officetel in Bucheon, Gyeonggi Province, tried to enter the underground parking lot by car last May, but when the barrier did not open automatically, she went to the security office on the first floor and suddenly struck security guard B (74, male) on the forehead with the corner of her mobile phone.
Then, A hit B's shoulder and buttocks five times with a fire extinguisher nearby and kicked his thighs several times with her foot.
While being investigated by the police for this incident, A visited the security office a month later to pay the parking fee.
When B met A, he said, "You are the person who hurt me. Don't you have a word of apology?"
Unable to contain her anger, A said, "You security guard son of a b****. Do you want to get hit again?" and kicked B's thigh.
It was confirmed that A had a prior record of assault, including throwing a stapler at someone's face and hitting a head with a soju bottle.
A was tried for special injury charges in June last year and was indicted again for assault a month later.
In the first trial, she admitted the charges and confessed, but during the final statement in last month's sentencing trial, she blamed B again and claimed her actions were self-defense.
Earlier, during the police investigation, A also gave false testimony, saying, "I committed the crime because I was threatened by B with a mobile phone." In a letter of remorse submitted to the court before the sentencing trial, she also criticized B, saying, "The security guard usually does his job carelessly. Look at the hot-tempered security guard."
B, who was assaulted, worried about not receiving proper medical expenses, accepted 2.5 million won from A and signed a settlement agreement but never received a proper apology.
The Incheon District Court announced on the 21st that A, who was indicted without detention on charges including special injury, was sentenced to one year in prison and was detained in court due to the risk of flight.
However, based on B's expressed wish not to punish, the court dismissed the assault charges against A.
The court said, "The defendant vented her anger on a socially vulnerable victim and showed so-called 'gapjil' behavior but did not truly reflect or repent her wrongdoing," and "The victim likely felt mental shock and humiliation from this incident."

It added, "Although the defendant submitted a settlement agreement stating 'the victim does not want punishment,' the sentencing factor of 'non-punishment' is meaningful only when the defendant repents the crime," and "Simply submitting a non-punishment intention to the court does not exempt the defendant from a prison sentence," explaining the sentencing rationale.
