Prosecutors Dismiss Charges Against Yoon Seok-yeol Over 'Court Analysis Document'... "Difficult to Recognize Charges" (Update)
[Asia Economy Reporter Choi Seok-jin] Prosecutor General Yoon Seok-yeol was cleared of charges on the 9th regarding the controversial "court panel analysis document" that sparked the "judge surveillance" controversy.
The Inspection Department of the Seoul High Prosecutors' Office dismissed the abuse of authority charge against Prosecutor General Yoon on the 8th in connection with the "court panel analysis document."
The Seoul High Prosecutors' Office stated, "We received the case regarding Prosecutor General Yoon from the Supreme Prosecutors' Office on December 8 last year and conducted an investigation. Excluding the Prosecutor General's command, we ascertained the facts by questioning those involved in the document's creation, including the Prosecutor General, and reviewed legal precedents to determine whether the crime of abuse of authority was established. However, we judged it difficult to recognize the Prosecutor General's guilt and thus dismissed the charges."
Meanwhile, the Supreme Prosecutors' Office Inspection Department (headed by Han Dong-su) is still investigating allegations that procedural violations occurred, such as omitting reports to the command during the investigation into the document-related suspicions.
The Seoul High Prosecutors' Office added, "The complaint case regarding 'violations of due process, etc.' transferred from the Supreme Prosecutors' Office is currently under ongoing investigation by the Criminal Division of the Seoul High Prosecutors' Office."
Previously, in November last year, then Minister of Justice Choo Mi-ae raised suspicions of "judge surveillance" during an emergency briefing related to disciplinary charges against Prosecutor General Yoon, alleging that Yoon had collected personal information and disposition data of judges presiding over major cases, including those involving former Minister of Justice Cho Kuk, through the Supreme Prosecutors' Office's Investigation and Policy Office.
In the same month, the Ministry of Justice requested an investigation into Prosecutor General Yoon for abuse of authority charges at the Supreme Prosecutors' Office.
However, most of the content in the document disclosed by Yoon's side was found to be publicly available information accessible via the internet, and some information about judges' dispositions was confirmed through prosecutors who participated in the trials.
The National Judges' Representative Meeting held the following month also formally placed the "court panel analysis document" on the agenda, but all proposals were rejected, and no separate position was expressed.

On December 24 last year, the Seoul Administrative Court, which suspended the disciplinary action against Prosecutor General Yoon, pointed out that the documents could be misused and were inappropriate, but stated that the evidence submitted by the Ministry of Justice alone was insufficient to recognize the disciplinary reasons claimed by the Ministry, requiring further hearings.
