US ITC Delays Ruling Again in 'K-Battery Lawsuit'
December 10th... Two Postponements Are Unusual
[Asia Economy Reporter Park So-yeon] On the 26th (local time), the U.S. International Trade Commission (ITC) postponed the final ruling date for the trade secret infringement lawsuit between LG Chem and SK Innovation over electric vehicle batteries to December 10th. This is the second postponement, following the initial rescheduling from December 5th to this date, and now extended by another six weeks. The ITC's unusual decision to delay the ruling twice has led to analyses that the battery lawsuit between LG Chem and SK Innovation is entering a deadlock.
The ITC decided on the second postponement through a commission vote but did not disclose the background or reasons. The announcement of the delay was made public around 4 a.m. on the 27th Korean time. LG Chem and SK Innovation, who were awaiting the ITC's final ruling, reportedly held busy internal discussions from early morning upon receiving the unexpected notice. Related article on page 14
Within the industry, it is expected that both companies, burdened by the prolonged lawsuit, will officially resume negotiations for a settlement. Both companies mentioned the possibility of an agreement in their statements on the same day. LG Chem stated, "We will continue to engage sincerely and firmly in the ITC lawsuit," adding, "Moreover, if the competitor approaches the issue with sincerity to resolve it, the door to dialogue remains open as a consistent principle."

SK Innovation also said, "It is clear that the ITC is thoroughly examining the issues of this case," and added, "Regardless of the postponement, we will faithfully and fairly proceed with the lawsuit." They further stated, "However, we hope both companies will wisely decide to promptly end the dispute to eliminate uncertainties caused by the prolonged lawsuit and focus on their core business."
