[2020 National Audit] 19% of Police Prosecutorial Opinions Result in 'Non-Prosecution'
[Asia Economy Reporter Lee Ji-eun] It has been revealed that 19% of cases sent to the prosecution by the police with a recommendation for indictment over the past six years were dismissed without prosecution.
Jang Je-won, a member of the National Assembly's Legislation and Judiciary Committee from the People Power Party, announced on the 20th that this was the result of analyzing the national audit data received from the Ministry of Justice.
During this period, the police sent a total of 4,437,178 cases to the prosecution with a recommendation for indictment, of which 834,651 cases were dismissed without prosecution.
Details of the non-prosecution dispositions include 78,514 cases of "no charges," 684,950 cases of "suspension of indictment," 1,113 cases of "not a crime," 69,703 cases of "lack of prosecution rights," and 371 cases of dismissal.
Among these, 2,897,733 cases (65%) resulted in indictment, and other dispositions such as suspension of prosecution, transfer to other jurisdictions, and referral to protective cases accounted for 704,794 cases (16%).

Rep. Jang pointed out, "Last year, the number of requests for review filed in objection to the prosecution's non-prosecution decisions exceeded 30,000, and constitutional petitions requesting the cancellation of the prosecution's non-prosecution decisions are also increasing every year," adding, "The police must conduct accurate investigations to issue recommendations for indictment."
