It has been about nine months since the trial was suspended in January after the special prosecution team led by Park Young-soo pointed out the bias of the court.
According to the legal community on the 6th, the Seoul High Court Criminal Division 1 (Presiding Judge Jeong Jun-young, Song Young-seung, Kang Sang-wook) plans to hold a preparatory hearing for the retrial of the bribery case involving Vice Chairman Lee and other Samsung officials on the afternoon of the 26th.
Earlier, the special prosecution team opposed the court's stance, expressed on January 17, that it would reflect the effectiveness of the 'Compliance Committee' established by Samsung in Lee's sentencing, accusing Presiding Judge Jeong Jun-young of having a preconceived notion and conducting a biased trial, and filed a motion to disqualify the court the following month.
At that time, the special prosecution team argued, "The compliance monitoring system is a standard that is only limitedly applied to corporations, not individual executives, even in the United States."
Subsequently, after the Seoul High Court dismissed the motion to disqualify the court, the special prosecution team appealed to the Supreme Court.
However, the Supreme Court also dismissed the appeal last month, stating, "It is difficult to find objective circumstances that reasonably recognize suspicion that the judge will conduct an unfair trial."
