'Nth Room Prevention Act' Applied to Internet Businesses with Annual Sales Over 1 Billion Won
[Asia Economy Reporter Koo Chae-eun] The Korea Communications Commission announced on the 22nd that it has prepared a revision of the enforcement decree of the 'Nth Room Prevention Act,' specifying the scope of target businesses and detailing the technical and administrative measures for internet service providers.
The revised enforcement decree defines the businesses required to implement technical and administrative measures as webhard service providers and value-added telecommunications service providers designated by the KCC, who provide services where users post and share publicly available information. Specifically, the targets are those with annual sales exceeding 1 billion KRW in the previous year, or with an average daily user count of over 100,000, or those who have received corrective orders related to illegal filming materials from the Korea Communications Standards Commission within the past two years.
Additionally, the KCC designates the businesses and services required to implement technical and administrative measures. Once designated as such, these businesses or services must establish a constant reporting function. They must also take measures to restrict search results when the information matches illegal filming materials by comparing the names of the information (such as using banned word functions and limiting related search terms).
In cases where the Korea Communications Standards Commission has reviewed illegal filming materials, the KCC requires the implementation of posting restrictions using designated technologies (such as filtering measures). The revised enforcement decree also specifies institutions and organizations authorized to request the deletion of illegal filming materials, including the Korea Women's Human Rights Institute, sexual violence victim counseling centers, and other institutions or organizations entrusted or subsidized by the government to perform distribution prevention tasks. The revised enforcement decree will be implemented after public notice and review by the Ministry of Government Legislation.

At the same meeting, the KCC also approved the re-licensing of SBS M&C, the broadcast advertising sales agency of terrestrial broadcasters. Chairman Han Sang-hyuk of the KCC stated, "We have prepared the enforcement decree draft to strengthen the obligations of internet service providers to delete and prevent redistribution so that victims suffering from illegal filming materials can be promptly remedied," emphasizing, "We will strictly apply the law to eradicate digital sex crimes."
