Husband in 'Gwanak-gu Mother and Child Murder Case' Appeals First Trial Verdict
[Asia Economy Reporter Seongpil Cho] The husband, who was indicted on charges of murdering his wife and 6-year-old son and sentenced to life imprisonment in the first trial, has appealed.
The prosecution also appealed, turning this case into a second-round battle at the Seoul High Court, the appellate court.
According to the court on the 1st, Jo Mo (42), who was indicted on charges including murder, filed an appeal on the 29th of last month, stating that he could not accept the first trial's verdict.
Jo's side reportedly appealed on grounds such as 'excessive sentencing,' 'misinterpretation of facts and law,' as they had consistently denied the charges from the investigation stage.
The prosecution submitted their appeal to the court on the 28th of last month, one day before Jo's side.
This is interpreted as a strategy to secure a sentence of life imprisonment or higher in the second trial, anticipating Jo's appeal.
Under current law, if the prosecutor does not appeal, the second trial cannot impose a sentence heavier than that of the first trial.
Earlier, the first trial court, the Criminal Division 33 of the Seoul Central District Court (Presiding Judge Donghwan Son), provisionally concluded that Jo was the perpetrator of this case and sentenced him to life imprisonment on the 24th of last month.
Jo was indicted on charges of killing his wife and son with a weapon in a multi-family house in Gwanak-gu, Seoul, in August last year.
This is the so-called 'Gwanak-gu mother and son murder case.'
The investigation authorities did not find the weapon used in the crime. No signs of external intrusion were found either.
However, through on-site forensic data and analysis by the National Forensic Service, Jo was identified as the perpetrator.
Jo strongly denied these charges during the investigation and trial process.

At the sentencing hearing, when the prosecution demanded the death penalty, he showed tears, saying he was "unfairly treated."
