[Asia Economy Reporter Moon Chae-seok] The Ministry of Government Legislation announced that it will strengthen services this year to make laws necessary for daily life, such as those related to the novel coronavirus infection (COVID-19), more easily accessible.
On the 16th, the Ministry of Government Legislation outlined its major tasks for this year, including providing daily life legal services, overseeing and supporting legislation to achieve national policy outcomes, and improving legal systems necessary for a fair and inclusive society.
In particular, it plans to focus on ▲ enacting the Framework Act on Administration ▲ revising laws to support economic vitality and a fair society ▲ expanding legislative exchanges leading the New Southern Policy.
First, the "Easy-to-Understand Legislation Project" will be expanded to delegated administrative rules and ordinances (650 items).
A voice search function will be implemented in the National Law Information mobile app. A comprehensive roadmap for overhauling the National Law Information System, incorporating everyday language legal searches, artificial intelligence, big data, and technology convergence, will also be prepared.
Additionally, laws of public interest such as those on infectious disease prevention and management including COVID-19, and immigration quarantine will be introduced through card news, Q&A, radio broadcasts, and internet portals.
Before the expiration of the 20th National Assembly's term, rapid processing of major policy bills will be promoted. Bills discarded due to the expiration of the 20th National Assembly at the end of May will be promptly reintroduced in the 21st National Assembly.
For reintroduction, procedures such as 'Ministry demand survey (March) → shortened consultation on legislative notice and Ministry of Government Legislation review (April-May) → legislative notice (May) → regulatory review (until June) → submission to Vice Ministers' Meeting, Cabinet Meeting, and National Assembly (June)' will be followed.
According to the Ministry of Government Legislation, government legislative procedures usually take at least three months, but discarded bills can be reintroduced by streamlining the government legislative process to about one month.
Legal opinions on current issues of each ministry will be promptly provided, and the scope of legislative drafting support will be expanded to delegated administrative rules and others.
Legislative drafting support is a system that reviews legal issues and assists in codification from the drafting stage to ensure that ministries' legislative proposals are drafted quickly and efficiently.
Furthermore, through activities such as promoting the enactment of the Framework Act on Administration and publishing and disseminating the Active Administration Legislative Guidelines 2.0, the government aims to innovate its legislative capabilities.
Key tasks for this year include administrative legislative innovation and enacting the Framework Act on Administration. Especially, since the Framework Act on Administration is the basic law for over 4,400 administrative laws, its enactment will be expedited.
The draft Framework Act on Administration was prepared last month, and after finalizing the bill in June, it will be submitted to the National Assembly.
In the economic sector, efforts will be made to ▲ revise outdated licensing facilities and business standards ▲ remove entry barriers for new businesses.
Regarding licensing, in areas where real-time transactions and business between individuals are possible online through platforms and the internet, relaxation of facility, personnel, and equipment standards will be considered.
For example, in fields like game production where small-scale businesses such as one-person companies can operate, the 'business office' requirement among registration conditions will be relaxed.
To prevent unfairness and favoritism, if work performance ability can be judged by requirements such as professional personnel, facilities, and equipment in various licensing regulations, the 'work performance record' requirement will be removed. This will fairly provide capable new entrants with opportunities to start businesses.
Moreover, Korea's legislative development experience will be shared with New Southern countries such as Indonesia. Continuous support will be provided for establishing Indonesia's legislative institutions and introducing the National Law Information System. The 8th Asia Legislative Experts Meeting will also be held in September.
