According to the Hillsborough County Sheriff's Office, Davis is accused of grabbing the puppy by the scruff of its neck and throwing it onto the road, then kicking the puppy when it approached her again. She was later found to have picked up the puppy once more and thrown it toward the bushes. This scene was captured by the sheriff's real-time crime monitoring center cameras, and after reviewing the footage, a staff member immediately dispatched deputies to the scene.
The puppy was rescued at the scene and transferred to an animal hospital. At that time, the puppy had injuries including a fractured leg, and no microchip was found. Authorities believe that this puppy may have been a lost or stray dog. Tampa Bay 28 quoted a representative from the Hillsborough County Pet Resource Center as saying that the puppy was extremely thin and may have approached people to seek food or help.

Sheriff Chronister pointed out at a press conference that there were people around the scene who witnessed the abuse but no one reported it. He strongly criticized the perpetrator, saying, "I believe that anyone who inflicted pain on this puppy will have a special place in hell someday." He also urged that if anyone witnesses suspected animal abuse, they should report it immediately to the local sheriff's office.
