Fair Trade Commission Orders Corrective Measures
for 10 Types of Unfair Terms at Baemin and Others
Kim Won-i, a member of the Democratic Party of Korea representing Mokpo, Jeollanam-do, raised concerns during last year's National Assembly audit regarding unfair terms and conditions in food delivery apps. As a result, the Fair Trade Commission has taken corrective action.
On October 14, the Fair Trade Commission announced that it had reviewed the terms and conditions of Baemin (Baedal Minjok) and Coupang Eats, identifying a total of 10 types of unfair clauses and ordering corrective measures. The main issues addressed include: ▲provisions that impose excessive burdens on partner businesses, ▲arbitrary changes to delivery exposure radius, and ▲unfair exemption clauses.
This action reflects the issues raised by Assemblyman Kim during last year’s audit of the Ministry of SMEs and Startups. At that time, Kim strongly criticized Baemin for "unilaterally applying unfavorable terms to partner businesses by abusing its dominant position," specifically highlighting ▲arbitrary changes to delivery exposure radius, ▲notification of disadvantageous changes, and ▲unfair exemption clauses.
Following a review by the Ministry of SMEs and Startups, the Fair Trade Commission determined these terms to be unfair and ordered improvements.

Assemblyman Kim stated, "I hope this corrective action will further strengthen fair business practices in the food delivery app market," adding, "I will continue to do my best to establish measures for mutual growth between small business owners and platforms, including addressing issues such as packaging fees, advertising costs, and the transfer of delivery fees."
