Husband Who Had Vasectomy Shocked by 'Contraceptive Device' in Wife's Bag
"Had a Vasectomy... Found Condoms in Wife's Handbag"
After Demanding Divorce, She Also Demands Daughter's Custody in Apartment
A man who underwent a vasectomy after having his first child discovered condoms (contraceptives) in his wife's bag, sparking a story that has been shared.
On the 24th, YTN Radio's "Attorney Jo Inseop's Counseling Room" featured the story of Mr. A, who could not accept his unfaithful wife's claim to her rights. Mr. A, who had a vasectomy after seeing his daughter four years ago, said, "I recently found condoms in my wife's handbag and was filled with an overwhelming sense of betrayal."
Mr. A immediately gathered evidence of the affair and filed a lawsuit for divorce and alimony against his wife and her lover. In response, his wife brazenly demanded the apartment and custody of their daughter.
Mr. A stated, "We purchased two apartments; one is jointly owned by us as a couple, and the other is in my name," adding, "I do not want to give the apartment to my wife, who is demanding the jointly owned apartment." He continued, "My wife said she expects to be designated as the custodian since she is the mother, but I cannot entrust our daughter to a wife who destroyed our family by having an affair," and asked for advice on how to protect his assets and custody rights.
"The division ratio of property is determined considering all circumstances"
Attorney Seo Jeongmin responded, "Being the at-fault spouse does not automatically presume unsuitability as the child's custodian," and explained, "For Mr. A to be designated as the child's legal guardian and custodian, he must prove that he was the primary caregiver, that the daughter wishes to live with her father, or that the wife has been abusive toward the daughter."

Regarding property division, he pointed out, "The court determines the division based on contributions to the total property, not just individual assets, and considers all other circumstances. Since the wife appears to have contributed to the purchase and maintenance of the real estate, it will be subject to division." However, he advised, "If Mr. A's parents helped with the apartment purchase, preparing evidence to dispute this could allow that portion to be recognized as Mr. A's separate property."
