She further advised, "The key point in a lawsuit for consolation money against the other woman is whether she knew the spouse was married and still engaged in an illicit relationship. In this case, it is necessary to verify whether the other woman truly did not know the husband was married or if that was just an excuse."
Attorney Kim also stated, "If the other party actively deceived by claiming not to be married or behaved in a way that made the other person mistakenly believe so, it can be seen as a violation of sexual self-determination rights," adding, "In such cases, the woman can actually claim damages for illegal acts infringing on sexual self-determination rights against the husband."
